Mercury Wars in Ventura County
36-year-old Jennifer, received debilitating headaches, cervical and lumbar strains and suffered a lower quality of life following her accident. Her ADL's included inability to ride horses or coach her daughter's soccer team.
She was stopped for a red light and was rear-ended by defendant.

Defendant Mercury did not contest liability. Defendant argued her injuries were exaggerated and she suffered no lingering residuals. 
Jennifer's total medical bills were $7,247. She did not offer any proof she had residual problems or needed future care, which was too bad.
In negotiations before trial Jennifer's attorneys demanded $10,500 to avoid trial. Mercury countered with $8,500.
The jury believed Jennifer and awarded her all her medical bills at $7,247 and her past pain and suffering at $10,000 for a combined award of $17,247.
The jury did not award any money for future pain and suffering or medical care.

  • The Jury may have awarded more if there was testimony regarding the need for future care and likelihood of future procedures.
