Our client Doug was lawfully riding southbound on Buena Vista Street in Duarte when the Defendant made a left turn into Doug’s path of travel.
Defendant crashed directly into Doug’s bicycle, knocking Doug to the surface.
Defendant USAA blamed Doug for ‘contributory’ negligence. USAA claimed further that Doug overtreated.
The chiropractor who managed this case worked with numerous medical doctors. The multiple injuries included a left clavicle fracture and a significant low back injury, which ultimately resulted in a two-level lumbar artificial disc replacement surgery.
Judge Bruce Minto adjudicated the settlement in the amount of $900,000.

1) Even with significant fracture cases chiropractic treatment can be essential;
2) Insurance usually blames the victim;
3) Doug did everything he could to avoid surgery with long time pre-surgical care—making this a very credible claim.

San Jose: Traffic Fatalities Rising
While fewer people have suffered injuries in the last 30 years, those killed by vehicle crashes has climbed over the last decade. In 2018 the San Jose’s Department of Transportation reports that 52 people died -- up from 46 the previous year.
Those killed were
NOT in cars. Instead almost 50% are pedestrians, and most of are over 65 years old. Speed and darkness are the key factors. Bicyclists were a leading factor for fatalities.
In 2015 the city adopted a Vision Zero Safety Initiative to have zero traffic deaths in a given year. However, the city also radically narrowed the streets for bicycle lanes causing massive competition as drivers and bicyclists compete to navigate the roads.
City officials asked for more ‘funding’ to study the problem.
