USING CPT CODE 97535 IN PI CASES BY GARY LEWKOVICH, DC

This may be the most underutilized code in PI. Yet billing for recommendations for home therapy, corrective exercises, posture modification is a key area for care. In PI cases the patient often suffers extensive ADL interferences.

This code is TIME BASED, requiring one on one contact with the patient. Most doctors do that but don't bill for their time and care.

Using this code provides proof that the treating doctor is fulfilling his/her obligation to treat PI patients in an evidence-based manner.

Harry, a movie producer and director, was rear-ended while stopped for a red light, by a suburban. Defendant happily admitted liability.

Neither car was towed from the scene. Harry did not go by ambulance or to the ER. Harry began chiropractic care some 90 days after the accident. He had over 200 sessions. Harry also sought trigger point injections and epidural injections in his neck and back.

Harry claimed the accident prevented him from engaging in productive work and thus lost considerable income.

Harry claimed $800,000 for lost earnings. Medical expenses for $13,809.02 and an additional $140,000 for pain and suffering.

The Jury thought otherwise. The trial lasted for 3 days. However, the Jury deliberated for only 40 minutes. Harry vs. Sargsyan LA Superior Court, EC056 248 June 17, 2013. Judge Leland Harris presiding.

Total award was $18,809


PRACTICE TIPS
1. Beware of delayed onset. The longer the delay the more unlikely the care is related to the accident.
2. Beware of extensive over treatment. No jury will tolerate 200 visits by any doctor.
