DACBR’s are highly trained in diagnosing biomechanical injuries. Often DACBR’s are more qualified than MD radiologists.

Issues to alert with your instructions to your DACBR with your PI x-rays are:

List your essential objective findings.
State relevant prior history.
State your Primary Concern.

Admitted liability gets poor result in Fresno

Too often we see tragic cases in the Jury Sheets that prove we need more education in Chiropractic Personal Injury. Richard Amaya, 40, drove his 1999 Toyota Camry westbound on Ashlan in Fresno. Defendant Adel Zamzami drove his 1999 Mercury Sable eastbound on the same street. Zamzami made a left turn in front of Amaya’s Toyota. In fact, defendant violated the Vehicle Code Sec 21801[a] which prohibits unsafe left turns. Defendant admitted fault.

Easy case? Not if the doctor fails to manage.

Amaya complained of soft tissue injuries, shoulder and sacroiliac sprain. Neither ambulance nor an ER visit took placed. With a total of $9,225 chiropractic bills only, the jury made short work of this claim.

Defendant insurance claimed that the care was grossly disproportionate to the injury claim. That for any doctor to incur over $9000 in care without any outside referrals or tests is nearly mal-practice.

PRACTICE TIPS:
  1. One DOC CASES in serious PI cases can give poor results. Implies “minor” injury.
  2. Beware when your bill begins to exceeds $5000—Call the attorney – discuss.
  3. If so much care was needed why not seek 2nd opinions & tests to justify care??
