Mercury pays $30,000 in Small Claims

Sometimes it is really sunny in California. Mercury playing their anti-people card, decided to stiff four claimants from their accident claims.

Under the direction of Small Claims Expert, Peter Dykeman DC, he filed 4 claims against Mercury asking for $7500 each. The medical bills were smaller than the demand.

Mercury offered to settle the cases for ½ of the medical bills.

Dykeman charges some $500.00 for each case plus costs. The family opted to sue in small claims. Dykeman appeared as an expert witness as an Accident Reconstructionist [Northwestern U] and as a medical witness.

DC VS. DC in court

Jose Carranza was rear-ended on 101 northbound in San Francisco. Defendant admitted liability, but claimed the impact was not the cause of any alleged injuries received by the victim.

There was a spectacular battle of experts which cost both sides a lot of money.

Plaintiff hired treating DC Steve Biegel, economist Dr. Allman, Dr. Kelkar PHD, accident recon and internist Krolikowski DO.

Defendants retained Jeremy Jones DC, radiologist Hoddick MD, and emergency physician Perchonock MD.

Plaintiff had only $3,010 in medical bills. $3526 in lost earnings.

Yet the jury after hearing hours of expert opinions awarded $61,606 to plaintiff, some 20 times more than the medical bills.

PRACTICE TIPS:
  1. Each side spent over $25,000 for just the experts to testify.
  2. Both sides gambled. Defendants lost not only the verdict but will have to pay plaintiff’s expert costs.
