THANK YOU – FOR THE BEST ATTENDED [SELL-OUT] AND MOST COMPREHENSIVE PI SEMIANR AT SCUHS

“Do I have to cut My PI lien? “

Q: “I have an important question. ...Every single time when it’s time to settle a case, the attorney or the client they always expect our office to take a cut. ... Do we have to take a cut? It’s too much already. Nobody like to work for free, what are our rights?”

Answer:

  • Too many DC’s have given up and assume that to do PI they must always reduce their liens.
  • This becomes a self fulfilling prophecy.
  • The DC that takes a stand and clears up any future misunderstanding needs to talk to the PI attorney when the patient is brand new.
  • The DC explains his approach:
    1. All new PI’s must pay a reasonable co-pay –between $10 to $20 dollars
    2. All PI’s are told in advance they must pay the balance no matter what the case outcome.
    3. That the DC will never consider a reduction unless the attorney cuts his fee, with other providers and the patient’s expectations are reasonable.

Boat Accident W/DC = $5,991,387

Jeffrey Koopen, 25, was a boat passenger operating on New Melones reservoir in Angels Camp. Defendant operator had been drinking. Defendant struck an invisible shallow island ejecting Koopen from the boat and hitting his head on a rocky shore.

Jeffrey immediately suffered a coma and TBI [traumatic brain injury] with joint contractures and a wrist fracture. His combined medical bills exceeded $300,000. Also, Koopen demanded $100,000 for future medical costs and $4 million for future wages lost.

Our hero, Dr. Hans Freericks, DC Fremont managed this case with Kaiser physicians and many psychiatrists.

Koopen vs. Alerle: HG 062 661 136; Judge David Hunter, Alameda Sup Court 4/24/12.

PRACTICE TIPS:
  1. The PI world needs to know that DC’s can and do manage multimillion dollar PI cases.
  2. That DC’s should and can work with Kaiser doctors..
