Too many DC’s and Too Much Care? Jury goes with DC’s

Driver Myoung Park was stopped when rear-ended by a SUV. She treated with three difference chiropractors because of her travels.

The insurance company denied the claim---that too many doctors were unnecessary. Their expert witness, Curt Comstock MD, orthopedic surgeon, San Jose claimed that 12 weeks would have been sufficient for her alleged injuries to heal.

After an 8 day trial, the jury in 1.5 days elected to award Park $35,750 in damages.

The key finding for the jury was proof of a herniated disk at L5—which continued to cause pain during the trial.

PRACTICE TIPS:
  1. So long as the patient is not “doctor shopping” juries will understand.
  2. This patient had to move to two locations during her six months of care.
  3. Each doctor collaborated with the other DC’s to coordinate report of findings.
  4. All three docs agreed and the MRI proved she suffered on-going residual complaints from a herniated disc.
