Arcelia suffered from Parkinson and Alzheimer’s. She required daily assistance, so her family placed her in a “memory care” facility which claimed they would provide 24-hour care.
The family also took Arcelia to a local DC for ongoing maintenance care.
The DC noted that Arcelia was suffering from a number of unexplained injuries, like bruises and a fractured femur.
The DC reported these findings to the family. The family sued the facility under the Elder Abuse and Dependent Adult Civil Protection Act.
The jury awarded $357,000 in compensatory damages and $4,000,000 in punitive damages.
