Making rational estimates of future care

Justifying future care is a crucial element when reporting out on your PI case. Insurance companies are happy when the doctor forgets to mention that the patient may not be 100% recovered. Fact is most people in a moderate to severe impact never fully recover.

“Leaving the door open” to future care is a means that will improve the VALUE of most PI cases.

Dr. Lewkovich, our PI GURU, has created a form that you should get from johntawlian@shawnsteel.com

Called “Determination of Future Care” will help answer the following questions:

“How did you arrive at your estimate of 10 visits over the next 12 months?”
“What is your evidence to support this opinion?”

PRESCRIPTION OVERDOSES

The LA Times reported in the Nov 11, 2012 article researched that some 3 MD’s in Southern California are responsible for 34 patients’ deaths since 2005. One of the doctor’s was quoted saying “You can’t say, ‘No. You don’t have pain...You’re just seeking drugs.”

Some risks pill dispensers need to consider:
  1. Risk factors include
    A] Substance abuser
    B] Mental health problems
    C] Past overdose
    D] Suicide attempt
    E] Past rehabilitation

35% of the fatal overdosed patients were in their 50’s.

The OC – Good Result

Nicole Gillespie was stopped at a red light, when she was rear-ended by a SUV. With severe complaints to her lower back Nicole received chiropractic care she was referred to neuro-surgeon Jeffrey Gross [Laguna Niguel]. Nicole continued chiropractic care with epidural injections.

Plaintiff demanded defendant’s policy limits of $50,000. Defendant countered with $25,000. Defendants hired notorious neuroradiologist Stephen Rothman plus old hand Hillel Sperling, orthopedic surgeon. Defendant also hired Thomas J. Szabo, an accident recon expert. The total costs for the three experts easily exceeded $20,000.

The OC jury made short work of the low ball offer and awarded Nicole $55,353. That is some 5,353 over their demand. The Court awarded an additional $22,147 to Nicole Gillespie for her court costs. The total award was $77,353.

Gillespie vs. Truax 30/2011-0042529, OC Superior Court July 24, 2012 Judge Frederick Horn.
