Is State Farm Discriminating Against Black and Armenian Claimants?

PIE Image base template _8_.png

“We have a lot of fraud in your area.”

The New York Times published a story March 18, 2022 of a black policyholder covered by State Farm for his six apartment units. This was the response from the State Farm adjuster when he filed a claim after sustaining a major pipe burst. Though the adjuster eventually paid a portion of his damages, the portion paid was small and was followed by in delays. This forced the policyholder to sell all six units.

Since then hundreds of discrimination suits were filed. Then came the whistle blower: Carla Campbell-Jackson. After working for State Farm for 20 years, she was promoted to manage SIU [Special Investigations Unit, which investigates criminal fraud cases].

As a black woman active in the NAACP, it didn’t take long for Campbell-Jackson to understand she would be the face for aggressive claim denials for black policyholders. She was fired for protesting State Farm policy and program, which “saved” some $136 million.

Her case is pending. At the same time another class action was filed by black agents being forced to work only in black neighborhoods. That case is also pending.

Discrimination Against Armenians?

Several attorneys in California are gathering evidence that Armenian policyholders may be specially profiled. It appears Armenian claimants get special ‘attention’ for potential fraud cases. We expect there will soon be litigation.

Fred Loya Insurances Gets Screwed

1.png

Don’t expect a fast settlement when you see a Fred Loya case. Instead, the cheap insurance company typically will not pay fair claims and will force small cases into extended litigation.

Marina, a single mom of three young children, was working for Uber when she was rear-ended by Defendant on the 110 Harbor Freeway. The Fred Loya policyholder drove away but the police got her license number. Defendant later admitted she fell asleep before impact.

Marina went to Kaiser ER then began chiropractic care. Her car was wrecked so she could not work for Uber.

Fred Loya claimed she needed only 30 days of care.

Fred Loya at mediation was advised to pay $10,250 [the policy limit was $15,000]. The final settlement was $7,500.

The jury thought otherwise. By a 10-2 vote they awarded Marina $45,404. Marina will also win interest and court costs. The jury was out in only 3 hours.
